| Subject: | Negligence, possible willful misconduct and low-quality services from Next |
Hi, good afternoon,
Recently, Next contacted me about compensation for the services provided at the Next White complex. I am undergoing a discussion with your lawyer regarding the services agreement. Essentially, I am willing to compensate Next, even retroactively, but I do not agree with several unreasonable clauses of the proposed agreements.
Your lawyer made this statement, however:
> On our side, we have undertaken an obligation to provide high-quality services, and we are also required by applicable regulations to have such agreements in place with all unit owners in the complex.
If I am to compensate Next for their high-quality service, it stands to reason that Next must compensate me for negligent or low-quality service, possibly involving willful misconduct, of which we have full documented evidence.
I recollect the following instances:
-
Your sales team mislead us during the purchase by stating our renovation project was possible, as well as an incorrect line dividing our apartment and the public area, which caused us to have to change the project midway.
-
Your engineer (Shota) embargoed our renovation based on bogus claims that it was not possible, and refused to look across the hall for another apartment joined like ours.
-
Shota then allowed our renovation to continue, but then came back later demanding our front wall to be destroyed and rebuilt further in,, which affected our project plans and apartment area.
-
The plastic gas pipe in our apartment, embedded in concrete, was ruptured, and Next provided no evidence it was delivered in good condition, expecting us to believe that somehow our renovation workers broke it.
-
Your customer relations person (Lola) has lied to us multiple times. Of the about 6 weeks we spent without gas due to the broken pipe, two can be attributed to her lies on how we should approach the problem. She also lied about consulting your engineers before our renovation (though it might have been the fault of upper management).
-
Your staff was unhelpful when our power meter malfunctioned, and mislead us to believe there was a 2 Lari debt with the electricity company, resulting in a whole work day lost without electricity.
The agreement proposed would put a ridiculous 10 Lari per day fine on Next for failing to uphold this "high quality" services.
Given that Next wishes to be fairly compensated for the complex services, I ask you: in fairness, how much do you think Next should owe us for these transgressions?
Regards,
Luís
